The author tried to look for an effective infringement law theory to explain the market share rules, eliminate the conflict between the two rule patterns and harmonize market share rules and common law infringement rules. Meanwhile, it employs evidence of community theory to solve the operation, system design and related problems in market share rules. It also discusses the necessity and feasibility of establishing market share rules in Chinas Infringement Law.
